Studio Policies
Please take a moment to familiarize yourself with the studio policies. A clear understanding of the policy will reduce confusion later on.

Scheduling and Payments

Booking
In order for us to best accommodate your needs, please try to give a minimum of one week advance notice on studio bookings. Scheduling of new sessions will be subject to the studio’s availability.

Weekend Scheduling
To arrange to have an engineer present on weekends or late at night, a minimum or overtime rate may be required.

Deposit

A deposit is required to book your session. The amount is 25% of the estimated session total or $50, whichever is greater. The deposit will be applied to your session or refunded if you cancel more than 48 hours before your session time. If your deposit is not received within 48 hours of your session time, your time may be forfeited to another client.

Payment
Full payment is required upon completion of each session. Payment may be made by cash, personal or company check, money order, Paypal, VISA, MasterCard, AMEX or Discover Card. There is a $35 fee for returned checks.

Pre-Production Meeting
A pre-production meeting may be required before booking a new project, to ensure that everyone is well prepared and that there is an understanding of the needs and expectations of both the client and the studio. This meeting is preferred to be in person, but accommodations can be made if that is absolutely not possible. At a minimum, a completed Studio Information Form must be submitted.

Masters
Your account must be paid in full prior to receiving your master (mixes, individual tracks, session files, etc.). Masters are generally provided on CD, DVD or hard drive, but may also be supplied on the format of the client’s choosing (if technically feasable). - All mixes, CD-R’s, Hard Drives, etc. shall remain the property of Creative Ej until all invoices are paid in full.

Studio Times

Billable Studio Hours
The billable time typically starts when the engineer begins working on your session and ends when the engineer finishes working on your session. It should be understood that we will bill you from the beginning of your scheduled time regardless of what time you arrive. Studio time is billed in quarter-hour increments. The clock begins when the engineer starts working with setting up equipment, setting up and wiring mics, getting levels, debugging instrument problems (such as hum, buzz, MIDI or SMPTE codes, etc.). Typically, the engineer will announce and/or document the exact session start time. When you indicate you are finished, and the equipment is no longer in use, the clock stops (If a master is being burned, the clock continues to run until the master is finished).

Setup Time
When possible, you may move in and start setting up prior to your start time. If the studio is available and the engineer is not present, there will be no charge until the engineer arrives. Please call the day before your session to determine if an early setup is possible.

Starting Time
When you schedule time, it is expected you will arrive on time and we adjust our work schedule accordingly.

Session Ending Time

We do our best to be flexible. If there is another session scheduled after yours, we ask that you be considerate and stop your project on time and schedule another session. It is always a good idea to estimate the amount of time you will need and schedule accordingly.

Open-Ended Time
If no one is scheduled after you, such as at the end of the day or on weekends, you may continue until you reach your goal or wish to stop (at the option of the engineer and Creative Ej). Keep in mind performers and engineers may become fatigued during long sessions, which could affect the quality of your work.

Session and Technical Details

Equipment Rental
If there is something you need that we do not have available, you may bring it yourself or request we rent it for you at prevailing rates. Any equipment damaged or broken by clients will be repaired or replaced at cost and billed accordingly.

Material Purchase
Hard drives may be purchased or rented. All other materials must be purchased and will become your personal property.

Studio Downtime
Creative Ej’s liability with respect to downtime of any and all studio sessions, as a result from equipment malfunction or availability, personnel, hired musicians, acts of nature or public utility companies, etc., shall be limited solely to the schedule studio time of session. Clients agree to hold Creative Ej harmless from any and all damages from such downtime.

Recording Hard Drives
Creative Ej will provide high speed hard drives for direct to disc recording for each session. All session files may be erased one week after the end of each session. Long term or large project clients will be required to buy their own project hard drive. If Clients wish to retain the session files for more than one week, or to have a backup copy (highly recommended!) in case of hard drive failure, then Clients will pay Creative Ej a one time fee of $150 which will cover the costs of one backup hard drive as well as incremental backups after each recording session. If Clients request additional backups, or prefer backups on CD, DVD, or any other media format, Clients will pay Creative Ej for both the media and the backup time.

Non-Recording Issues

Food and Beverage
All foods and drinks are permitted only in the kitchen/break room area. Bottled water is permitted in the studio for vocalists, but must be safely kept from equipment. No food or drinks are to be brought into the control room. We ask you to clean up after yourself and be mindful that you are responsible for any damages that may occur.

No Smoking
Smoking is prohibited on the premises (inside and outside).

Alcohol and Drugs are strictly prohibited
We reserve the right to deny access to our premises to those suspected under the influence of drugs or alcohol.

Guests
Please do not bring anyone with you who is not a part of the recording process, including boy/girlfriends, friends, relatives, etc. Do not bring young children along with you to the studio for more than a few moments before and after the session, and only if necessary. Our facility is not equipped to handle childcare, and you will be held liable for any damages you and your guests cause to the studio.

Legal Issues

Restricted Recordings
As a professional recording studio we respect the intellectual property rights of all artists. We reserve the right to cancel your session, and return your deposit, if we believe you are infringing on the copyrighted material of others.

Liability
Creative Ej is not responsible for:

• Data left on premises, including the dissemination or loss of data.
• Educating or instructing any client on the care and safety of digital data.
• Unrecoverable data, whether it be on tape, hard drive, or any other medium.
• The storage of client data. Clients are responsible to provide their own hard drive or storage devices to back up their data at the end of each session.

Clients assume all risks associated with storing, on or off the premises of Creative Ej, or Creative Ej’s use of, any and all sound recordings, video recordings, digital data in any storage format including but not limited to audio, video, smpte, midi, or other file types, or equipment of any kind or nature and shall hold Creative Ej harmless from any and all damage that might occur to said articles for any reason.

Notices
ANY AND ALL DAMAGE TO THE BUILDING, PERSONS ATTENDING SESSION, AND EQUIPMENT USED DURING THE USE OF THE FACILITY, BY CLIENT AND/OR THEIR VISITORS, IS THE SOLE LEGAL AND FINANCIAL RESPONSIBILITY OF THE CLIENT. ALL DAMAGE COSTS INCURRED BY THE CLIENT MUST BE PAID IN FULL BY NO LATER THAN (48) FORTY-EIGHT HOURS FROM THE TIME THAT THE INCIDENT OCCURRED. CREATIVE EJ, INC. IS NOT LEGALLY OR FINANCIALLY RESPONSIBLE FOR ITEMS BROUGHT INTO OR LEFT ON THE PREMISES. IT IS RECOMMENDED THAT CLIENTS OBTAIN INSURANCE TO PROTECT AGAINST POSSIBLE DAMAGE EXPENSE OR LOSS OF ARTICLE(S) OF VALUE LEFT ON THE PREMISES, INCLUDING EQUIPMENT, MASTER TAPES, HARD DRIVES, OR ANY MEDIA LEFT AT CREATIVE EJ DURING SESSIONS OR BEFORE PAYMENT.

MAKE MULTIPLE BACKUPS OF YOUR DATA. DIGITAL AUDIO CONSIDERED SAFE UNLESS IT IS IN THREE SEPARATE LOCATIONS. THIS IS YOUR RESPONSIBILITY! BACKUP COPIES OF SESSIONS IN THE DIGITAL REALM SHOULD BE MADE DAILY DURING THE COURSE OF A SESSION AND TAKEN HOME WITH THE ARTIST OR PRODUCER AT NIGHT. POST-SESSION BACKUPS CAN BE MADE ONTO INTERNAL HARD DRIVES OF COMPUTERS, ONTO EXTERNAL FIRE-WIRE OR USB HARD DRIVES, STORED IN AN ONLINE DATA STORAGE BANK OR BURNED TO DVD-R OR CD-R. THERE IS NO CERTAINTY THAT A CD-R OR DVD-R WILL HOLD DATA FOR THE LONG TERM OR THAT A STORED HARD DRIVE WILL PLAY BACK AFTER SITTING FOR ANY AMOUNT OF TIME SO BACK UP YOUR DATA TO NEWER MEDIA AS TIME GOES ON. CREATIVE EJ HIGHLY RECOMMENDS PURCHASING QUALITY, NAME BRAND HARD DRIVES (Seagate Recommended).

Any change or interpretation of the policies is the sole discretion of Creative Ej, Inc.
